Changes in Refugee Status Determination in Brazil throughout the 25 years of Law 9.474/97 and their impacts on the protection of refugees

The process of Refugee Status Determination (RSD) in Brazil has its basic architecture in Law 9.474/97, which celebrated its 25th anniversary in 2022 and which established not only its main basis but also the National Committee for Refugees (CONARE), the organ vested with the responsibility to implement it. Throughout the 25 years of the law, changes have been established to RSD in Brazil, mainly by infra-legal norms, such as CONARE’s Normative Resolutions and by laws. In light of this, this article aims to describe and systematizes the modifications in RSD in Brazil since the promulgation of Law 9.474/97, so as to assist in the beginning of assessments of, in their impacts on refugee protection in Brazil, through the lens of integral protection, embedded in International Refugee Law and International Human Rights Law.
