Solidarity and Fraternity. A new ethical-political key for migrations

Abstract

This article aims to analyze from a philosophical and political perspective the current debates around the figure of the "crime of solidarity" in France, taking as a starting point the case of Cédric Hérrou, prosecuted and convicted in various instances for having provided aid to migrants sans papiers. Emphasis will be placed on the decision of the French Constitutional Council which, in July 2018 and in the name of the Fraternity principle, rendered null and void the figure of the "crime of solidarity" in cases where the aid provided was given for purely humanitarian reasons and within of the French territory. We consider that this case has an exemplary value when thinking about theoretical dilemmas, as well as the ethical-political power of migrations in the current democratic orders.

    Ana Paula Penchaszadeh holds a degree in Political Science from the University of Buenos Aires (UBA), a Master's in Sociology & Political Science from FLACSO (Argentina), a PhD in Social Sciences from the UBA and a PhD in Philosophy from the Université Paris 8. At the Currently, she is a Deputy Investigator of the National Council of Scientific and Technological Research of Argentina, based at the Gino Germani Research Institute of the Faculty of Social Sciences of the UBA and professor of graduate and postgraduate studies at the UBA. It addresses issues related to migration, hospitality, human rights and new political forms of citizenship in the contemporary world and directs the PICT Project "Practical power of post-foundational political thought. Keys to the understanding of different figures of otherness in the contemporary world ", CONICET-IIGG / FCS / UBA (2017-2020, BID). She is the author of numerous academic articles and dissemination of human and social sciences and the book Política y hospitalidad. Disquisiciones urgentes sobre la figura del extranjero (Eudeba: Buenos Aires, 2014).

    Senda Sferco holds a degree in Anthropology from the National University of Rosario (Argentina), Diplomate in Cultural and Artistic Studies the School of Arts of Indonesia (STSI Denpasar), Doctor of Social Sciences of the National University de Quilmes (Argentina) and PhD in Philosophy at Université Paris 8 (France). She serves as Researcher of the National Council of Scientific Research and Technologies based at the Gino Germani Research Institute of the UBA and as a graduate and postgraduate professor at the Universidad Nacional del Litoral. She studies the fields of contemporary philosophical and political thought, especially in relation to the problematization of temporality that governs the production of subjectivity and political action in the present. She is engaged in several research projects and she is co-director of the PICT Project "Practical power of thought post-foundational political Keys to understanding different figures of otherness in the contemporary world ", CONICET-IIGG / FCS / UBA (2017-2020, BID), dir.
